Terms of Service

These Terms constitute a binding legal agreement between you ("Customer", "you") and Auracle ("we", "us", "our"). By accessing or using the Service — including any dashboard, API, or mobile application — you confirm that you are at least 18 years old, have the authority to enter into contracts on behalf of your organization, and accept these Terms in full.

If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Auracle provides an Answer Engine Optimization (AEO) SaaS platform that tracks and scores how brands appear across AI answer engines, including but not limited to Claude (Anthropic), ChatGPT (OpenAI), Perplexity, and Google Gemini. Core features include:

• AI Visibility Index (AVI) scoring — a proprietary 0–100 composite metric
• Brand mention tracking, sentiment analysis, and citation tracking
• Competitor gap analysis
• AI-generated content briefs, FAQ blocks, and site audits
• Email digests and scan-complete notifications
• Daily automated brand scans (Pro and Enterprise tiers)

We reserve the right to modify, suspend, or discontinue any feature or the Service as a whole at any time with reasonable notice. Material changes to paid features will be communicated with at least 14 days' notice.

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at legal@goauracle.com if you suspect unauthorized use.

You may invite team members to your organization workspace under the roles of Owner, Admin, Member, or Viewer. You are responsible for ensuring that all users within your organization comply with these Terms.

Auracle offers the following subscription tiers:

Payments are processed by Lemon Squeezy, our Merchant of Record. By subscribing to a paid plan, you agree to Lemon Squeezy's terms and authorize them to charge the payment method on file on a recurring monthly basis.

Subscriptions renew automatically at the end of each billing cycle. You may cancel at any time through the billing portal accessible from your account settings. Cancellation takes effect at the end of the current paid period — no partial refunds are issued for unused time unless required by applicable law.

We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect your current billing cycle.

You agree not to:

• Use the Service to scan competitors' brands without a legitimate business purpose (e.g., market research for your own brand positioning is permitted; competitive intelligence sold to third parties without our consent is not)
• Reverse-engineer, decompile, or attempt to extract proprietary algorithms
• Use automated means to access the Service in excess of normal usage (our API has published rate limits — respect them)
• Introduce malware, spam, or any content designed to interfere with the Service's operation
• Resell or sublicense access to the Service without our written consent
• Provide false information about brands, domains, or your organization that misleads our AI models
• Violate any applicable law, including data protection, privacy, or intellectual property law

Violations may result in immediate suspension or termination of your account without refund.

Our IP. The Service, including the AVI scoring algorithm, software, design, and proprietary content, is owned by Auracle and protected by intellectual property law. These Terms do not grant you any ownership rights.

Your IP. You retain all rights to your brand data, domain information, and any content you upload to the Service. By using the Service you grant us a limited, non-exclusive, royalty-free licence to process your data solely to provide and improve the Service.

Aggregated insights. We may use anonymized, aggregated, non-identifiable data derived from usage patterns to improve our models, benchmarks, and service quality. This will never include your raw brand data in a form that identifies you.

You are responsible for the accuracy and legality of all data you submit to the Service, including brand names, website domains, and keyword lists.

Our handling of personal data is described in detail in the Privacy Policy. For data processed on your behalf (e.g., employee emails in your team workspace), you act as the data controller and we act as a data processor.

You may export or delete your data at any time through the account settings. Upon termination, we will retain your data for up to 90 days before permanent deletion, unless earlier deletion is legally required.

The Service integrates with third-party platforms to deliver its functionality. By using the Service you acknowledge that:

• AI Engines — Your brand name, domain, and generated prompts are sent to Anthropic, OpenAI, Google, and Perplexity to perform scans. These providers have their own terms and privacy policies.
• Supabase — Our database and authentication provider. Data is stored on infrastructure operated by Supabase, Inc.
• Lemon Squeezy — Payment processing and subscription management. Payment card data is handled exclusively by Lemon Squeezy and is never stored by Auracle.
• Resend — Transactional email delivery (scan-complete notifications, weekly digests).

We are not responsible for the availability, accuracy, or practices of any third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

AI engine outputs, AVI scores, competitor data, and recommendations are for informational purposes only. We do not guarantee that any specific action will improve your brand's visibility in AI-generated answers. AI engines are operated by independent third parties whose ranking behavior may change without notice.

We do not warrant that the Service will be uninterrupted, error- free, or that defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AURACLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

Some jurisdictions do not allow limitations on implied warranties or liability — in those cases the above limitations apply to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Auracle and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or third-party right; or (c) any data you submit to the Service.

By you. You may cancel your account at any time from the billing settings page. Cancellation of a paid plan takes effect at the end of the current billing cycle. Deleting your account immediately removes access.

By us. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail to pay amounts due. We will endeavour to provide notice before termination except where immediate action is necessary to protect the Service or other users.

Upon termination, sections covering intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive.

We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice within the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Auracle is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration or in the courts of that jurisdiction.
